Terms of Service

These Terms govern your use of the CalBud app provided by Ember Development Studios, LLC. By using CalBud, you agree to these Terms. If you do not agree, do not use the app.
1. The service
CalBud is an AI-assisted calorie and macronutrient tracker. All nutrition values are estimates for general wellness and are not medical, dietary, or professional health advice.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use CalBud.
3. Your account
Keep your login credentials secure and provide accurate information. You are responsible for activity under your account. Notify us of any unauthorized use.
4. Subscriptions and billing
CalBud offers a free tier and CalBud Pro. New accounts get a 7-day full-access free trial. Pro is billed through the Apple App Store or Google Play via your store account and auto-renews each period until you cancel. Manage or cancel your subscription in your store settings; cancellation takes effect at the end of the current period. Prices are shown in the app before purchase. Except where required by law or store policy, payments are non-refundable and are handled by the app store, not by us.
5. Acceptable use
Don't misuse the app: no unlawful, harmful, or abusive use; no attempts to reverse engineer, disrupt, or gain unauthorized access; no uploading content you don't have the right to share; and no using the service to violate others' rights.
6. Your content
You keep ownership of the food logs, photos, and text you add. You grant us a limited license to store and process that content solely to operate the service for you (including AI analysis). You are responsible for anything you choose to share in group features.
7. AI estimates
Meal analysis is automated and approximate; accuracy is not guaranteed and results may vary. Do not rely on CalBud for medical, allergy, or clinical decisions. Verify important information independently.
8. Intellectual property
CalBud, its design, and its software are owned by Ember Development Studios, LLC and protected by law. These Terms don't grant you any rights in our trademarks or software except to use the app as intended.
9. Termination
You may stop using CalBud and delete your account at any time from Profile. We may suspend or end access if you violate these Terms or to protect the service. Provisions that by nature should survive termination will survive.
10. Disclaimers
The app is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that nutrition estimates will be accurate.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or reliance on, the app or its estimates. Our total liability is limited to the amount you paid us for the app in the 12 months before the claim.
12. Governing law
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located in Florida, unless your local law requires otherwise.
13. Changes and contact
